1. What this warranty covers
THIS IS A LIMITED WARRANTY.
RevApple, LLC warrants to the original end purchaser that the StitchSitter hardware, when purchased new from RevApple, LLC or from an authorised dealer, will be free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of original purchase.
This warranty is not transferable and applies only to the original purchaser. Proof of purchase from RevApple, LLC or an authorised dealer is required for any claim.
2. What we will do
If a defect covered by this warranty is reported within the warranty period, we will, at our sole option and as your exclusive remedy, repair the product, replace it with a product that is new or equivalent to new in performance and reliability, or refund the purchase price upon return of the product.
A replacement product or part assumes the remaining warranty of the original product or ninety (90) days from the date of replacement, whichever is longer. Any product or part that is replaced becomes our property.
3. What this warranty does not cover
- Damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause.
- Damage caused by operating the product outside the conditions or uses described in our published documentation.
- Damage caused by service, modification or repair performed by anyone who is not authorised by us, including opening the enclosure.
- A product that has been modified to alter its functionality or capability, or on which firmware other than firmware supplied or authorised by us has been installed.
- Cosmetic damage, including scratches, dents and worn markings, that does not affect functionality.
- Consumable parts and normal wear, and any third-party memory card or accessory not supplied by us.
- A product whose serial number or other identifying marking has been removed, defaced or altered.
- Any product not purchased new from us or from an authorised dealer, including any counterfeit product.
- Loss of, or damage to, any design file, artwork or other data, and any cost of recovering or recreating it.
- Damage to, or malfunction of, any embroidery machine or other equipment used with the product, except to the extent caused by our gross negligence and not excludable by law.
4. Compatibility is not warranted
Embroidery machines vary widely in how they read storage devices, and their behaviour can change with the machine manufacturer's own firmware updates, which are outside our control.
5. How to make a claim
Contact the authorised dealer from whom you purchased the product, or write to us at sales@stitchsitter.com with your proof of purchase and a description of the problem. Do not return any product without first obtaining a return authorisation from us or from your dealer. You are responsible for the cost of shipping the product to us unless applicable law provides otherwise.
6. Disclaimer of other warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY IS THE ONLY WARRANTY APPLICABLE TO THE PRODUCT AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WHERE IMPLIED WARRANTIES CANNOT BE DISCLAIMED, THEY ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.
No dealer, distributor, agent or employee is authorised to make any modification, extension or addition to this warranty on our behalf.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RevApple, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING ANY LOSS OF PROFITS, REVENUE, BUSINESS, PRODUCTION TIME, DESIGNS OR DATA, ARISING OUT OF OR RELATING TO THE PRODUCT, WHETHER BASED IN CONTRACT, TORT OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PRODUCT SHALL NOT EXCEED THE PURCHASE PRICE ACTUALLY PAID FOR THE PRODUCT.
You are responsible for maintaining your own backup copies of your design files. The product moves and stores files, and no storage device or file transfer is immune from failure.
8. Your statutory rights, which this warranty does not replace
This limited warranty is given in addition to, and does not affect, any right you have under the law of your own country. Those rights exist whatever this document says, and where anything here conflicts with them, your statutory rights prevail.
- United States. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on how long an implied warranty lasts, so the limitations in sections 6 and 7 may not apply to you.
- European Union and United Kingdom. If you bought as a consumer, you have a legal guarantee that the goods conform to the contract, enforceable against the seller for a minimum period set by law, which is two years in most member states and comparable in the United Kingdom. That right is free of charge and is not affected by this warranty.
- Australia. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Elsewhere. Consumer protection law in many other countries provides comparable non-excludable rights. Nothing in this warranty is intended to exclude, restrict or modify any of them.
